Privacy Policy
Introduction
Depending on what you do when you visit any website on the internet, you are providing information about your visit to that website's owner. This includes SportsMatrix.com (“SMX”).  We use the information that we get from your visit for internal tracking purposes, to SMX as useful and interesting to you and other users as we can, and to respond to requests for information or other services. Except as specifically noted below, we do not use our users and members personal information for any other purpose, we never sell it to any third party, and we never share it with any third party.

Here is how we handle information we learn from you when you visit our website.

Browsing
When you visit SMX and move from page to page, read pages, or download content onto your computer, we learn which pages you visited, what is downloaded, the domains you came from (e.g. 'aol.com,' or 'google.com') and the addresses of websites you visited immediately before coming to SMX.  However, none of this is associated with you as an individual.  It is measured only in aggregate.

We use cookie technology as part of our login procedures for some content and features. The information in the cookies lets us store your login information so you do not have to enter it many times during your viewing session. These cookies do not capture an email address or other personal information about you, and cannot be read by any website other than SMX.

We also use standard web server log files, to help us count visitors and evaluate SMX's technical capacity. We use this information to find out how many people visit SMX, help us arrange the pages in the most user-friendly way, keep SMX browser-friendly, and make our pages more useful to you and other users. We record information on website traffic for advertising purposes, but not information on individual visitors to SMX, so no information about any user or member in particular will be kept or used.

Email
When a user or member sends us an email to comment on something or ask us a question, we learn their exact email address and the thoughts they share.  We use these email addresses to thank them for their comment and/or reply to their questions, and we will store these communications and our reply in case we correspond further.
 

We require valid email addresses of our registered account users and members for several reasons. First, email is the best method for providing you with your initial login information to access SMX areas.  A valid email address proves that you actually exist, and lets us get this information to you quickly. Second, we use the email addresses to notify you of breaking news and updates, advertisements and promotions, and/or changes to SMX or our services.

Wireless and Other Alert Services
We may also provide the ability for you to enter an alternate email address for a pager, cell phone, or other wireless device. These email addresses are used exclusively for specifically-designed updates that you select and fully control. Our Privacy Policy with respect to Email above also applies to these devices.

Advertisers
We utilize banner ads and other advertisements that are purchased by various companies. We supply these companies with information on SMX user traffic and other general demographic information on our readers, but we provide this information in aggregate, and DO NOT give them any of our user’s registration information unless members specifically opt in for those services. Again, any information you enter in a registration form or other information is protected by this privacy policy, and we WILL NOT give this information to anyone.

Third Party Advertising
We may use various third-party advertising companies to serve ads when users visit SMX  These companies may use information about member visits to SMX and other websites in order to provide advertisements on SMX and other websites about goods and services that may be of interest to you and other users. Such usage may include geographical targeting by IP address, as well as other methods.

Third Party Cookies
In the course of serving the advertisers on SMX, our third-party advertisers may place or recognize a unique "cookie" on your browser.

Linking To Other Sites
Please remember that when a link is used to go from SMX to another website, our Privacy Policy is no longer in effect.  Your browsing and interaction on any other website, including websites which have a link on SMX, is subject to the rules and policies of that website.  Please read over those rules and policies before proceeding.

COPPA Compliance
The Children's Online Privacy Protection Act (COPPA), effective April 21, 2000, applies to the online collection and disclosure of personal information from and about children under the age of 13.  The rules spell out what a website operator must include in a privacy policy, when and how to seek verifiable consent from a parent and what responsibilities an operator has to protect children's privacy and safety online.

The Children's Online Privacy Protection Act applies to individually identifiable information about a child that is collected online, such as full name, home address, email address, telephone number or any other similar information that would allow someone to identify or contact the child. 

In addition to us having met the requirements of COPPA in regards to procedure, privacy policy and notice, we shall not make public on SMX, or provide to third parties, the full name, home address (including home town), e-mail address, telephone number, or any other information that would allow a third party to contact a child under the age of 13 years without verifiable parental consent from the parents of that child as described below. 

We shall only disclose the full name and/or hometown of any Child under the age of 13 by first obtaining verifiable parental consent from the parent of such child.  Verifiable parental consent shall come via submission of a Verifiable Parental Consent Form accompanied by digital signature.  At any time, a parent may revoke his/her consent by similar use of the same procedure.  Note: We will not at any time disclose any other contact information such as street address, e-mail address, or phone numbers for any Child under the age of 13 even if the parent of such child requests or consents.

Compelled Release Of Information
In certain situations, we may be asked to release member personal information to judges, police, law enforcement personnel, officers of a court, or other entities.  By using SMX and our services, you agree that we are in no way liable for any result of the release of this information at our discretion, and that we have the right to disclose this information upon request to a third party, if, from a legal standpoint, we feel that it is necessary or in our best interests to do so. Contact us for additional information on the process for compelled release of personal information.

In addition, by using SMX and/or registering as a member oF SMX, you agree that, should there be any dispute regarding the above release of personal information, this agreement shall be governed pursuant to the laws of the State of Michigan and venue for such a dispute or any other dispute shall be in Oakland County, Michigan.  If such a dispute is filed and we are forced to defend our right to release personal information, users and members agree that we, upon successfully defending this right, shall be entitled to obtain our costs of defense, including attorney’s fees.
